What if a creditor sues me?

Bankruptcy Frequently Asked Questions

Are you buried in credit card debt, medical debt from an unexpected, expensive personal injury or illness, or debt caused by the cost of an expensive divorce?

Do you fear that a creditor will sue you to get the money you owe?

I am the bankruptcy lawyer with more than 30 year of experience that can help you in Northern California (Antioch, Pittsburg, Brentwood, Concord, Oakland, San Francisco and ….). I am Mark A. McLaughlin. My law office offers experienced, compassionate, reliable legal representation to every individual or family client.

If you have been sued by a creditor, you should see a lawyer right away. Even if the creditor tells you that there's nothing a lawyer can do, you owe it to yourself to meet with one and find out.

Contact my full-service Mark A. McLaughlin bankruptcy law office today, for a free consultation: (925) 754-2622. You can also e-mail me. I promise to respond promptly.

I have handled many cases where creditors attempted to collect on debts when they had absolutely no right to do so. Some creditors try to collect on debts that have been barred by the statue of limitations. Some creditors try to collect on debts they don't even own. In most cases, they get away with this because debtors tend not to hire lawyers and raise the right objections.

Some debtors would only have to show up in court to prove they don't owe the debt. But since they think it's a lost cause, they don't — and they end up having to pay.

If you can't pay a debt like a credit card bill and you don't want to face a lawsuit, then your other option is to file for either a Chapter 7 or Chapter 13 bankruptcy. Once you file for bankruptcy, the court will issue an "automatic stay," which orders your creditors to immediately stop all of their efforts at collections.
